Terms and Conditions for Viatva

Welcome to Viatva! These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and Viatva ("the Platform"), governing your access to and use of our services, which connect adventure seekers with groups and events for outdoor activities. By using our Platform, you acknowledge that you have read, understood, and agree to comply with these Terms. Please review them carefully before proceeding.

1. Acceptance of Terms

By accessing or using Viatva, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must refrain from using the Platform.

2. Eligibility

  • You must be at least 18 years old to use Viatva. By registering an account, you confirm that you meet this requirement.

  • If you are accessing the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that entity to these Terms.

3. Account Registration and Security

  • To access certain features of the Platform, you may be required to create an account.

  • You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

  • Viatva reserves the right to suspend or terminate accounts at its discretion if any misuse, fraudulent activity, or violation of these Terms is detected.

4. Use of the Platform

  • Users: Adventure seekers can browse, book, and participate in outdoor activities through Viatva.

  • Organizers: Event hosts may list and manage adventure activities for Users.

  • All Users and Organizers must provide accurate and up-to-date information.

  • Viatva reserves the right to remove or suspend any content, event listing, or account that violates these Terms.

5. Third-Party Bookings and Payments

  • Viatva does not process payments or handle transactions for event bookings.

  • Users are directed to third-party platforms or event organizers to complete bookings and payments.

  • Refund and cancellation policies are determined solely by the event organizers and should be reviewed before booking.

  • Viatva is not liable for any payment disputes, cancellations, or refunds but may assist in providing relevant information for dispute resolution.

6. Assumption of Risk and Liability Disclaimer

  • By participating in any event listed on Viatva, you acknowledge and accept the inherent risks associated with outdoor activities.

  • Viatva is a facilitator and does not assume responsibility for injuries, accidents, losses, or damages incurred during these activities.

  • Users are advised to assess their own physical capabilities and ensure they have necessary insurance coverage before participating.

7. Prohibited Activities

You agree not to:

  • Use the Platform for unlawful, deceptive, or fraudulent purposes.

  • Post or distribute misleading, harmful, or offensive content.

  • Harass, threaten, or endanger other users.

  • Engage in unauthorized commercial use of the Platform.

  • Attempt to disrupt, hack, or interfere with the Platform’s operation.

8. Limitation of Liability

  • Viatva provides a digital marketplace for adventure-related activities but does not control or oversee individual events.

  • Viatva is not liable for the actions, omissions, or failures of event organizers or participants.

  • To the fullest extent permitted by law, Viatva disclaims any warranties or liabilities regarding the quality, safety, or legality of any events listed on the Platform.

9. Intellectual Property Rights

  • All content on Viatva, including but not limited to logos, text, graphics, and software, is owned by or licensed to Viatva.

  • Users may not reproduce, distribute, or modify any content from the Platform without prior written consent from Viatva.

10. Indemnification

You agree to indemnify and hold harmless Viatva, its affiliates, employees, and partners from any claims, damages, losses, or liabilities arising from:

  • Your use or misuse of the Platform.

  • Your violation of these Terms.

  • Any disputes between you and an event organizer or another user.

11. Modifications to Terms

  • Viatva reserves the right to update or modify these Terms at any time.

  • Any changes will take effect immediately upon posting on the Platform. Continued use after modifications constitutes acceptance of the updated Terms.

12. Termination of Use

  • Viatva reserves the right to suspend or terminate access to the Platform for any violation of these Terms.

  • Users may delete their accounts at any time; however, certain obligations may survive termination.

13. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of India.

  • Any disputes arising from or related to these Terms shall be resolved through arbitration or courts located in India.
